Parl. nuclear bill against Constitution

TEHRAN, Jun. 24 (MNA) – Government spokesman Mohammad Bagher Nobakht said on Tuesday that Majlis newly-passed motion on nuclear talks is against the Article 176 of Iranian Constitution.

Government Spokesman Mohammad Bagher Nobakht made the remarks on Tuesday during his weekly press conference.

He maintained that according to the Article 176 of the Constitution, the issue of nuclear negotiations belongs to the responsibilities of the Supreme National Security Council (SNSC) and not to the Executive or Legislative bodies of the government.

Nobakht further stressed that the negotiating team and the government will report to the parliament, all organizations as well as the public about the progress of nuclear negotations, adding, however, that not all questions in regard to the negotiations could be answered since that would reduce the maneuverability of Iranian negotiators during the course of nuclear talks.

Vice President for Parliamentary Affairs Hojjatoleslam Ansari also voiced government's opposition against the Parliament's bill, saying that the Parliament's entry into the SNSC's field of responsibilities is considered against the Constitution.

The Iranian lawmakers on Tuesday ratified a legislation that would oblige the government to safeguard nuclear rights and achievements of the Iranian nation. The motion was adopted by the parliament with 213 votes in favor, 10 against and 6 abstentions from a total of 244 representatives who took part in the voting.

The legislation obliges Foreign Minister Mohammad Javad Zarif to report the process of implementation of a possible final nuclear deal to the Iranian lawmakers every six months.

It also says that the SNSC should provide a report to Majlis every six months about the proper implementation of a possible final deal.

The motion further stresses that the regulations set by the SNSC have to be fully observed and that the outcome of the nuclear talks should be reported to the Majlis based on Article 77 and Article 125 of the Constitution.
